Ballet North Texas supports an educational environment that recognizes and values diversity in all its forms, including diversity of cultures, learning styles, physical abilities, gender identity, ethnic and racial backgrounds, sexual orientation, religion, and worldview.

 

We actively work toward building an intentionally diverse and inclusive organization and community. We strive to create an environment that fosters peace and encourages the understanding of common human needs and community activities. By promoting sensitivity to and appreciation of differences among people, we help our employees, students and company members to learn important values and become thoughtful, responsible citizens of the world.

NON-DISCRIMINATION STATEMENT

Ballet North Texas does not discriminate on the basis of race, color, sex, gender identity, physical ability, national and ethnic origin, or religion in administration of its rehearsal and training policies and procedures, admissions policies, scholarship programs, and other organizational programs. 

 

Ballet North Texas and North Texas Conservatory admit students and company members of any race, color, national and ethnic origin, and gender identities to all the rights, privileges, programs and activities generally accorded or made available to members of its organization.  It does not discriminate on the basis of race, color, sex, or national and ethnic origin in administration of its policies, admission policies, scholarship programs and other school and company programs.

1. Agreement to These Terms
These Terms of Use govern your access to and use of the Ballet North Texas website and any related online forms, registration systems, audition portals, ticketing links, payment platforms, digital applications, and other online services operated by or on behalf of Ballet North Texas. Together, these are referred to as the “Site.”
Ballet North Texas is a nonprofit performing arts and dance education organization. In these Terms, “Ballet North Texas,” “BNT,” “we,” “us,” and “our” refer to Ballet North Texas and, where applicable, its affiliated training and educational programs.
By accessing the Site, purchasing tickets, making a donation, registering for a program, submitting an audition or employment application, completing a form, or otherwise using the Site, you acknowledge that you have read and agree to these Terms of Use.
Additional policies may apply to specific programs, purchases, auditions, performances, classes, scholarships, rentals, or services. These may include registration agreements, tuition policies, attendance policies, refund policies, waivers, audition requirements, ticketing policies, codes of conduct, and our Privacy Policy. When applicable, those additional policies are incorporated into these Terms by reference.
If you do not agree to these Terms, you should discontinue use of the Site.
2. Eligibility and Use by Minors
The Site is intended primarily for use by adults, including parents, legal guardians, donors, ticket purchasers, applicants, educators, artists, and community members.
Because Ballet North Texas provides programs and opportunities for children and youth, a parent or legal guardian may use the Site to register, apply, submit information, purchase services, or provide consent on behalf of a minor.
Children under the age of 13 should not independently submit personal information through the Site. Information concerning a child under 13 must be submitted by, or with the authorization of, the child’s parent or legal guardian.
Individuals between the ages of 13 and 17 may use the Site only with the knowledge and permission of a parent or legal guardian when registration, payment, audition, employment, participation, medical, or other personal information is involved.
By submitting information concerning a minor, you represent that you are the minor’s parent or legal guardian or that you are otherwise legally authorized to provide the information and consent.
3. Intellectual Property
Unless otherwise indicated, the Site and its contents are owned by, licensed to, or used with permission by Ballet North Texas.
This includes website text, photographs, video, audio, choreography documentation, production materials, educational materials, graphics, logos, trademarks, program descriptions, audition materials, designs, branding, databases, and other content.
You may view, download, or print reasonable portions of the Site for personal, educational, and noncommercial use.
You may not reproduce, modify, republish, distribute, sell, license, publicly display, commercially exploit, or create derivative works from Site content without prior written permission from Ballet North Texas or the applicable rights holder.
Nothing on the Site grants ownership or a license to use Ballet North Texas trademarks, logos, production photographs, choreography, recordings, or other protected materials except as expressly authorized in writing.
4. Accurate Information
When submitting a registration, application, audition, donation, payment, inquiry, or other form, you agree to provide information that is accurate, current, and complete.
You are responsible for updating information when necessary, particularly contact, billing, emergency, medical, and authorized pickup information related to participation in Ballet North Texas programs.
Ballet North Texas may decline, suspend, or cancel a registration, application, audition, purchase, or program participation when information is materially inaccurate, incomplete, misleading, fraudulent, or submitted without proper authorization.
5. Registrations, Auditions, Classes, and Programs
Registration or submission through the Site does not guarantee admission, casting, employment, scholarship assistance, placement, enrollment, or participation.
Program availability may depend on capacity, eligibility, age, experience, artistic requirements, payment status, attendance requirements, safety considerations, and other program-specific criteria.
Audition and casting decisions may consider artistic, technical, production, scheduling, safety, and educational requirements. Ballet North Texas reserves the right to determine casting, placement, repertory, faculty assignments, and participation requirements consistent with the needs of the organization and production.
Participation may require additional agreements, waivers, medical information, emergency contacts, photo or media permissions, attendance commitments, tuition agreements, or codes of conduct.
Program-specific policies provided during registration or enrollment will govern if they conflict with general information on the Site.
6. Tickets, Purchases, Donations, and Payments
Ticket purchases, registrations, tuition payments, program fees, donations, merchandise purchases, and other transactions may be processed through third-party platforms.
Prices, fees, performance dates, seating availability, programming, casts, venues, and schedules are subject to change.
Purchases and registrations are governed by the refund, exchange, cancellation, and attendance policies presented at the time of the transaction or provided through the applicable ticketing or registration platform.
Donations are voluntary and are subject to any restrictions accepted by Ballet North Texas. Ballet North Texas may decline a gift when accepting it would conflict with the organization’s mission, policies, legal obligations, or best interests.
Tax acknowledgments will be provided when applicable. Ballet North Texas does not provide individual tax, legal, or financial advice.
7. Submitted Materials
The Site may allow users to submit photographs, videos, resumes, biographies, audition recordings, artistic materials, applications, forms, training histories, written statements, or other content. These materials are referred to as “Submitted Materials.”
You represent that:

  1. You have the right to submit the materials.

  2. The materials are accurate to the best of your knowledge.

  3. Submission does not violate another person’s intellectual property, privacy, publicity, or contractual rights.

  4. Any necessary permission for materials involving a minor has been obtained from the minor’s parent or legal guardian.

You retain ownership of your Submitted Materials.
By submitting materials, you grant Ballet North Texas a limited, non-exclusive, royalty-free right to receive, store, review, reproduce, and internally distribute the materials as reasonably necessary to evaluate your submission, communicate with you, administer the relevant program, maintain organizational records, and provide the requested service.
Submission of materials does not automatically grant Ballet North Texas permission to use them publicly for advertising, publicity, or fundraising. Public use of identifiable photographs, videos, biographies, or similar materials will be governed by a separate media release, participation agreement, employment agreement, performer agreement, or other applicable consent.
Ballet North Texas may remove, reject, or request correction of materials that are unlawful, harmful, misleading, inappropriate, or inconsistent with these Terms.
8. Acceptable Use
You agree not to use the Site to:

  1. Violate any applicable law or regulation.

  2. Submit false, fraudulent, misleading, or unauthorized information.

  3. Impersonate another person or misrepresent your relationship with an individual or organization.

  4. Harass, threaten, intimidate, exploit, or harm another person.

  5. Upload malicious code, viruses, spyware, or other harmful technology.

  6. Attempt to gain unauthorized access to accounts, systems, records, or restricted portions of the Site.

  7. Interfere with the operation, security, or availability of the Site.

  8. Scrape, collect, reproduce, or commercially exploit Site data or content without written permission.

  9. Use automated tools to submit forms, create registrations, extract information, or overwhelm the Site.

  10. Infringe the intellectual property, privacy, publicity, or other legal rights of Ballet North Texas or another party.

  11. Use information obtained through the Site to contact, identify, target, or exploit students, minors, dancers, employees, volunteers, patrons, or families for an unauthorized purpose.

Good-faith criticism, reviews, complaints, and legally protected communications are not prohibited by these Terms. Ballet North Texas encourages concerns to be communicated respectfully through the appropriate organizational contact.
9. Community Conduct and Safety
Ballet North Texas is committed to maintaining an environment that supports artistic expression, education, accessibility, dignity, and safety.
Individuals using the Site or participating in related programs may be subject to additional conduct and safety policies.
Ballet North Texas may restrict access to the Site or participation in programs when conduct presents a safety concern, disrupts operations, interferes with the rights of others, violates applicable policies, or is inconsistent with the organization’s legal responsibilities.
10. Accessibility and Accommodations
Ballet North Texas is committed to improving access to its performances, educational programs, community activities, and digital information.
Individuals who experience difficulty accessing information through the Site or who need an accommodation related to a performance, class, audition, program, or other activity may contact Ballet North Texas.
Some accommodations require advance coordination and may depend on the venue, service provider, or nature of the request. Ballet North Texas will make reasonable efforts to address accessibility needs and provide effective communication consistent with applicable law.

11. Third-Party Services
The Site may contain links to third-party ticketing systems, registration platforms, payment processors, email providers, social media platforms, video services, maps, or other external websites and services.
These services are operated independently and may have their own terms, privacy policies, accessibility features, fees, and security practices.
Ballet North Texas is not responsible for the content, availability, accuracy, security, or practices of independently operated third-party services. A link to a third party does not necessarily constitute an endorsement.
You should review the terms and privacy practices of any third-party service before providing personal or payment information.
12. Privacy
Our collection, use, storage, and disclosure of personal information are governed by the Ballet North Texas Privacy Policy and any additional notices provided through a registration, application, audition, or payment platform.
When information concerning a minor is collected, it should be submitted by or with the authorization of the minor’s parent or legal guardian.
The Site may use cookies and similar technologies for necessary website functions, analytics, communications, and other purposes described in our Privacy Policy.
13. Performance and Program Changes
Live performance and educational programming may be affected by artistic needs, performer availability, illness, weather, venue conditions, public safety concerns, government requirements, labor or transportation disruptions, technical difficulties, or other circumstances beyond Ballet North Texas’s reasonable control.
Ballet North Texas may modify programming, casting, repertory, schedules, instructors, locations, formats, or performance details when reasonably necessary.
When a performance, class, or program is canceled, postponed, or materially changed, available remedies will be determined by the applicable ticketing, registration, tuition, or cancellation policy.
14. Site Availability and Disclaimer
The Site is provided on an “as available” basis.
Ballet North Texas makes reasonable efforts to provide accurate and current information but does not guarantee that every page, schedule, price, cast listing, program description, or other item will always be complete, current, or free from error.
To the fullest extent permitted by law, Ballet North Texas disclaims warranties that are not expressly stated in these Terms.
Nothing in these Terms limits rights or remedies that cannot legally be waived.
15. Limitation of Liability
To the fullest extent permitted by law, Ballet North Texas and its directors, officers, employees, dancers, faculty, contractors, volunteers, representatives, and affiliates will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising solely from use of, or inability to use, the Site.
This limitation does not apply where liability cannot be limited under applicable law and does not replace the terms of any separate participation agreement, ticketing agreement, waiver, employment agreement, performer agreement, or other written contract.
16. Indemnification
To the fullest extent permitted by law, you agree to be responsible for claims, losses, or expenses resulting from your unlawful use of the Site, your material violation of these Terms, your infringement of another party’s rights, or Submitted Materials that you did not have authority to provide.
Ballet North Texas reserves the right to participate in the defense of a claim involving the organization.
17. Suspension or Termination
Ballet North Texas may suspend or terminate access to the Site when reasonably necessary to protect the Site, the organization, its users, or the rights and safety of others.
This may include situations involving fraud, unauthorized access, harmful conduct, material violations of these Terms, security threats, or misuse of personal information.
Termination of Site access does not automatically cancel financial, contractual, or participation obligations established through a separate agreement.
18. Electronic Communications and Signatures
By submitting forms, sending email, registering for programs, making online payments, or completing electronic agreements, you consent to receive related communications electronically.
Electronic confirmations, agreements, waivers, notices, policies, and signatures may satisfy requirements that a communication or agreement be in writing, to the extent permitted by law.
Marketing communications will be handled in accordance with applicable law and the preferences or unsubscribe options provided with those communications.
19. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Unless another written agreement requires a different process, legal proceedings relating to these Terms or use of the Site shall be brought in a court of appropriate jurisdiction located in Dallas County, Texas.
20. Severability and No Waiver
If any provision of these Terms is found to be unlawful, invalid, or unenforceable, the remaining provisions will remain in effect.
Failure by Ballet North Texas to enforce a provision does not waive the right to enforce that provision in the future.
21. Changes to These Terms
Ballet North Texas may update these Terms to reflect changes in its programs, technology, operations, legal obligations, or organizational policies.
The updated date will be posted at the top of this page. Continued use of the Site after revised Terms are posted constitutes acceptance of the revised Terms.
